Margaret Leota Smithwick

      She was daughter of Irish immigrants and she was youngest of five children. Her nickname was "Maggie". She was a wonderful seamstress;always dressed up & quite a lady. She could sew anything without a pattern. She died at Longwood Rest Home in Chicago, IL. She was there 2 months before her death. She was living with her son, Jess, until that time at 2512 E. 72nd St. in Chicago. On her death certificate lists her parents as being born in Dublin, Ireland. Other records (family Bible) state Tipperary, Ireland. Her death certificate states she died of carcinoma of uterus with extension to bowel & bladder. She died at 11:45 pm. Other conditions listed on death certificate: arteriosclerosis, stroke.
     This is a picture of old St. John church (1854 - 1888) located on John St. in New Albany, IN. The church is now torn down. This is where Will & Maggie were married. A new church was built at where Thirteenth crosses Spring St. The name was changed to Trinity Methodist Episcopal Church ( 1888 - 1958). It then was moved to 2796 Charlestown Rd. & the name was changed to Trinity United Methodist Church.
     He came to the United States in 1848 (during the potato famine) with his wife , Johanna Leota Harland, & family; his brother, Oliver & his family came with them also. William was born in Tipperary, Ireland according to Bible records. Johanna was born in Dublin, Ireland according to her daughter's death certificate. Her father was James Harland/Harlan. I have not been able to find out anything about him; possibly his wife's name was Emma.
     William resided at South Vincennes in New Albany, IN. On July 12,1855 he bought a parcel of land from Ezekiel R. Day & his wife, Lucinda. He paid $300 dollars for the tract of land located in New Albany, IN.; the North 25 twenty five feet of Lot N# two fronting Upper Vincennes St. 25 ft. & extending back the same 120 ft. Recorded in Floyd Co. Deeds Vol. 4 page 19 on July 17, 1855. On July 9th,1856, recorded in Order Book 1 Common Pleas Oct. 1855-1861 p. 177 in New Albany, IN. William Smithwick, a native of Ireland and residing in the County of Floyd applied to become a citizen of the United States. On testimony of William Jackson states that William Smithwick hath continued to reside within and under the jurisdiction of the US five years at least, and at least one year immediately preceding this application within the state of Indiana. Application accepted.
     From "New Albany Daily Ledger" New Albany, IN. Ap. 15, 1891 p.5 c.2 William Smithwich, an old and well known resident of this city and father of officer Thomas Smithwick, died on the 14th inst, at his residence on South Vincennes Street, after a long illness, aged seventy years. Deceased had been a resident of New Albany for over half a century, and his death will be a sorrow to his family and many friends. His funeral takes place at 2:30 p.m. Thursday.  His wife's obituary: From "Public Press" New Albany, IN. Tuesday Dec. 26, 1911 p.5 Mrs. Johanna Smithwick, 94 years of age, widow of William Smithwick, was found dead in her bed at 8:30 last Friday night in the home of her daughter, Mrs. Ella Dieckman, 1615 Dewey St., where she resided. Mrs. Smithwick had been disabled from a broken hip for about twelve years. She had retired about two hours before and Mrs. Dieckman, before going to bed, went to her mother's room to see how she was resting and discovered that she was dead. Mrs. Smithwick was a native of Ireland, but had lived in New Albany for fifty years. She leaves a son, Capt. Thomas Smithwick, and five daughters, Mrs. D.S. Jocelyn, Mrs. William McNeff, Mrs. William Stewart, Mrs. Jeff Kern and Mrs. Dieckman, all of New Albany. From her death certificate states that she died of organic heart disease. Death certificate recorded Floyd County Health Dept. Book No. CH22 page 43. Funeral under direction of Newland Gwin Funeral Home.

This is the last will and Testament of Henry Smithwick Esqr. late of Pegsboro, but now of Barnlough in the County of Tipperary where he has been residing for many years with his brother Peter Smithwick Esqre revoking and making void all former wills or will made by him at any time, heretofore,

First I give devise and bequeath to my said Brother Peter Smithwick and to his heirs and assigns All that and those the Town and Lands of Pegsborough in the said County of Tipperary as now held by George Bradshaw Esqre and the rent issues and profits of the same

Second I give leave and bequeath to my said Brother Peter Smithwick and unto my Brother [sic, nephew] Thomas S Manning of Ruan Lodge Esqre All that and those that part of the Lands of Coolaronga which I now hold under Lord Portarlington share and share alike and the rents issues and profits of same during my term of Lease of said Lands

Third I give and bequeath to my said brother Peter Smithwick the Sum of £225.5.0 Stg. amount of a Judgment Bond due to me of Peter Smithwick of Suir Ville in the said County of Tipperary Esquire together with all interest due thereon to pay and satisfy my said Brother Peter Smithwick for a sum of £300, which I now owe him and for which he has my promissory note

4th I leave and bequeath to my nephew Robert Smithwick son of my late Brother George Smithwick the sum of £100 Stg which is to be paid to him out of my property (except Pegsborough) but not to be paid to him for two years after my Decease this last _ of £100 is to be paid out of the Lands of Coolaronga by my said Brother Peter Smithwick and my said Nephew Thomas S. Manning share and share alike,

5th I leave and bequeath to my said Brother Peter Smithwick a Policy of Insurance in the Sun office in Clonmel on the life of Peter Smithwick of Suirville for three hundred pounds with the amount of all money paid by receipts or otherwise on account of said Insurance I having only receivd two years Policy from the said Peter Smithwick of Suirville

6th I leave and bequeath to my sister in Law Eliza Smithwick wife of my said Brother Peter Smithwick and to her daughter Eliza my Mare _ bar and harness I leave my Library Books, Book Case and Secretary to my Nephew Thomas Smithwick Eldest son of my said Brother Peter Smithwick. I leave my writing desk to my Nephew Robert son of my said Brother Peter Smithwick And lastly I constitute and appoint my said Brother Peter Smithwick and my said nephew Thomas S. Last Will and Testament of Peter Smithwick of Barnlough - Transcribed by Robert J. Smithwick, Jr.

In the name of God Amen, I, Peter Smithwick of Barnlough in the County of Tipperary Esquire being of sound mind memory and understanding but considering the uncertainty of this Mortal life Do make publish and declare this as and for my last will and Testament hereby revoking and annulling all former and other will and wills and Codicils by me at any time heretofore made I direct that my funeral expenses and all my Just debts shall be paid by my Execs herein after named as soon after my decease as they conveniently can do so

I leave demise and bequeath all my right title and interest in the Lands of Barnlough and the dwelling house therein which I hold from the Reprs. of Lady Caroline Damer Deceased unto my eldest son Thomas Smithwick and to his heirs and assigns subject to the Head rent payable thereout and also subject to the Charges herein after particularly mentioned that is to say in the first place subject to the payment of a Sum of £500, which I hereby charge upon my said Lands of Barnlough and which I Direct to be paid to my Execs hereinafter named with legal interest from the day of my Decease towards forming a fund for payment of the legacies herein after specially bequeathed to some of my younger Children hereinafter named and to form a part of my personal property and in the event of non payment of said Sum of £500, at any time within twelve months after my decease by sale or otherwise of said Lands or a Competent part thereof for the purposes aforesaid

I leave and devise unto my dear wife Eliza Smithwick during her life an annuity of £100 ste. a year which I hereby also charge upon my said lands of Barnlough said annuity to be made in lieu bon and satisfaction of a certain jointure provided for her by my marriage settlement the lease of the lands which said jointure was made changeable with having expiring and I further declare said annuity of £100 a year is to be made in lieu Bon and satisfaction of all other claims which she may have or make upon my estates and properties real and personal for dower or _ or otherwise said annuity of £100 to be paid by two equal half yearly payments. On every 1st day of May and 1st day of Nov in each year the first payment thereof to Commence and fall due on whichever of said days shall happen next after my decease and in case said annuity or yearly sum of £100 shall happen to be behind hand or unpaid by the space of 21 days my or either of the days appointed for the payment thereof then so often as it shall so happen it shall and may be lawful to and for my said wife into and upon the said lands of Barnlough or any part thereof to enter and _ and the distress and distresses there and these found to take lead drive and carry away and impound and thereof to dispose according to Law for payment and Satisfaction of the said annuity and all arrears thereof and all Costs and Charges and Expenses incurred in the taking and Sale of such distress.

I leave devise and bequeath all my right title and interest in the Lands of Lisheen which I hold from the repose of the late James Hewett Massy Dawson unto my second son Robert Smithwick subject to the Head rent payable thereout and also subject to the payment of the Charge of £100 herein after mentioned. I also leave devise and bequeath all my right title and interest in that part of the Lands of Barnlough containing 140 acres or thereabouts which I bought from my late Brother Henry Smithwick unto my said second son Robt Smithwick subject also to the head rent payable thereout and also subject to the payment of the said charge or sum of £400 which I hereby charge upon my said lands of Lisheen and that part of said Lands of Barnlough which I bought from my said brother Henry Smithwick and which I direct to be paid to my Executors hereinafter named with legal interest from the day of my decease towards forming a fund for payment of the legacies hereinafter specially bequeathed to others of my younger children hereinafter named and to form a part of my personal property and in the event of the nonpayment of said sum of £400 at any time within twelve months after my decease by sale or otherwise of said lands or a Competent part thereof for the purposes aforesaid.

I leave devise and bequeath all my right title and interest in the lands of Pegsborough unto my fourth son Henry Smithwick subject to the Head rent payable thereout.

I leave and bequeath unto my third son Peter Smithwick the sum of £600 and my wish and desire is that he should be brought up to such business as he may be best fitted for.

I leave and bequeath unto my fifth son John Smithwick the sum of £500

I leave and bequeath unto my my daughter Eliza Smithwick the sum of £600, and unto my daughter Martha Smithwick the sum of £500 and the like sum of £500 unto my daughter Kate Smithwick and the further and like sum of £500 to my daughter Letitia Smithwick and in case of the death of any my said children Peter Smithwick John Smithwick Eliza Smithwick Martha Smithwick Kate Smithwick and Letitia Smithwick under age and without having been married my will is that the legacy or Legacies bequeathed to him her or them so dying as well as his or her original legacy or such sum as he or she may become entitled to by survivorship or forfeiture shall be divided amongst the surviors and survivor of all and every any children share and share alike. The said several legacies to bear interest at the rate of 5 pounds per cent from the day of my decease and to be paid and payable to each of my said children on their arrival at age or day or days of marriage provided they respectively shall marry with the consent of my Executors hereinafter named or the survivor or survivors of them or such of them as may at and my will is that in case any of my said children shall marry under the age of 27 years with out the consent of my said Exors hereinafter named or the survivors of them or such of them as shall act as such Executors or Executor that the legacy or legacies of him her or them so marrying without such consent and also such sum shall pay the respective legacies hereinafter particularly mentioned to my several and respective children at the respective times aforesaid out of the produce of of all and singular my personal property which alone together with the two said charges of £500 and £400 I make chargeable herewith and I hereby appoint my said daughter Eliza Smithwick my residuary Legatee to whom I leave devise and bequeath the part residue and remainder of all such property real and personal as I shall die possessed off or entitled unto of every kind and description real freehold and personal as I shall die possessed of or entitled unto of everh kind and description real freehold and personal in possession remainder or expectancy and not herein reposed of by this my last will and lastly I hereby Nominate Con_itate and Appoint Henry Smithwick of Mount Catherine Esqu Peter Smithwick of the Town of Tipperary M.D. and George Smithwick of Cottage Esqu Execs of this my last will and testament and guardians of my said several children. In witness thereof I have herein to this my last will and testament subscribed my name and affixed my seal this 9th day July 1836 and have subscribed my initials to each page hereof consisting of six pages.

Notes for John Smithwick:
     Athassel Abbey, co. Tipperary, Ireland - Athassel Abbey just outside the village of Golden and five miles from Cashel was built around 1200 by the Anglo Norman William de Burgh. The priory and Athassel town were burnt by the local Irish ruling family, the O'Briens in the 14th century. Parts of the priory's cloisters, gatehouse and chapter house are still standing. The town was never rebuilt after being burnt the second time.
     Athassel abbey  - Athassel, Ireland
Set in an idyllic landscape of verdant green rolling hills along the banks of the River Suir, the ruins of Athassel Abbey stand as a romantic symbol of Ireland’s legendary past. Dedicated to St. Edmund, the abbey was founded in 1192 by William Fitz Aldem de Burgo, a Norman aristocrat, for the Augustinian Order. Athassel grew to become the largest medieval priory in Ireland and a force in local politics. Unfortunately, this led to friction with the local ruling family, the O’Briens, who put Athassel to the torch in the mid-fifteenth century. Surviving features include the chancel with its lancet windows, multiple carved elements, the remains of the cloister, and the bridge with its associated gatehouse. Although the site is recognized by the government as a national monument and protected structure, Athassel suffers from many of the problems associated with ruins. Exposed to centuries of Ireland’s constant rains and brutal winters, the rate of deterioration is accelerating. The effects of natural aging, water penetration, and vegetation have been compounded by cattle grazing about the monument. Seasonal flooding of the site further exacerbates these factors. To date, a conservation plan has yet to be developed and a comprehensive solution involving all of Ireland’s heritage bodies is required to secure Athassel’s future.

A Memoriall [sic] of an indented Deed of Lease bearing date the eighteenth day of November in the year of our Lord one thousand seven hundred and forty six made between Mrs. Ann Foulke of Youghall in the County of Corke Widow of the one part and Peter Smithwick of Killduffe in the County of Limerick Gent of the other part reciting that said Ann Foulke for the Considerations in said Deed mentioned hath demised unto the said Peter Smithwick all that and those that part of Ballycannon lately held by David Butler containing one hundred and forty acres plantantion measure situate lying and being in the Barony of ClanWilliam and County of Tipperary for and during the lives of Peter William and Patrick three sons of said Peter the Lease with Covenant of Renewal for ever Yielding and paying therefore and thereout yearly unto the said Ann Foulke her heirs Executors administrators and assigns that Rent or Sum of sixty pounds sterling, which said Deed is witnessed by Benjamin Greene of Youghall in the County of Corke Gent and by John Quinnane of Killduffe in the County of Limerick Yeoman and by Robert Gore of Youghall aforesaid Schoolmaster and this memoriall is witnessed by the said John Quinnane also by Michale Hiffernan of the town and County of Tipperary Gent
